JUSTICE TANVIR AHMED KHAN, JUDGE SUPREME COURT OF PAKISTAN Address By Mr. Justice Nazim Hussain Siddiqui, Chief Justice of Pakistan [16th January, 2004] Brother Judges; Mr. Makhdoom Ali Khan, Attorney‑General for Pakistan; Qazi Muhammad Anwar, Vice Chairman, Pakistan Bar Council; Mr. Tariq Mahmood, President, Supreme Court Bar Association; Members of the Bar; Ladies and Gentlemen; We have assembled this morning to bid farewell to our colleague Mr. Justice, Tanvir Ahmed Khan, who is laying down the robes of his office today after having been a member of the Superior Judiciary for over 15 years out of which he spent more than three years with us in the Supreme Court of Pakistan. Mr. Justice Tanvir Ahmed Khan is unassuming, modest and soft- spoken. As a Judge he has displayed exemplary qualities of patience and understanding of human affairs. His opinions are balanced and his devotion to duty was, remarkable. He had full grasp of all judicial principles. I will, not repeat what the other speakers have said about him. I knew Mr. Justice Tanvir Ahmed Khan, firstly, by his remarkable judgments, secondly, by his excellent reputation and thirdly, when he came to Supreme Court as a Judge. He has sterling qualities of head and heart and always utilized these faculties for doing complete justice between the parties. I always found him eager to do substantial justice between the parties and never allowed technicalities to overshadow the same. During his tenure as a Judge of Supreme Court, he has given some landmark judgments, which will provide tangible guidelines for all of us and also to those who will follow us. I will not go in detail about those judgments, but I will simply refer some of his reported judgments such as‑‑ * Mst. Arshan Bi v. Maula Bakhsh (2003 SCMR 318) * Tahira Begum v. Syed Akram Ali (2003 SCMR 29) * Sajjawal Khan v. Wali Muhammad (2002 SCMR 134) * Ladha Khan v. Mst. Bhirawan (2001 SCMR 533) * Ghulam Hussain v. Jamshed Ali (2001 SCMR 1001) * Muhammad Gulshan Khan v. Secretary, Establishment Division, Islamabad (PLD 2003 SC 102) * Jameela Pirbakhsh v. Appellate Authority (2003 SCMR 1524). * Muhammad Anwar Khan v. Chaudhry Riaz Ahmed (PLD 2003 SC 491). * Muhammad Asad Ullah Sheikh v. Government of Pakistan (2003 SCMR 392) * IGP Punjab v. Muhammad Tariq (2001 SCMR 789), and * Khalid Saeed v. Shamim Rizwan (2003 SCMR 1505). * The Bench and that Bar are the two pillars on which stands the edifice of the system of administration of justice. Both the Bench and the Bar must work together to strengthen the system. As everywhere in the world, the Courts in Pakistan are faced with heavy backlog. Concerted efforts at all levels are necessary to meet the challenge. We must forget our differences, which were the result of misunderstanding and make sincere efforts to bring efficiency in the judicial system so that miseries of the litigant public are eliminated. Every. individual, be he a Judge, a lawyer or anyone else, who, in any way is concerned with and has a role in the system of administration of justice, must make his positive contribution. We have the potential to improve things. We must make use of it lest it is too late. I wish a very happy and long life for Mr. Justice Tanvir Ahmed Khan. Thanks.
