INCOME TAX, SALES TAX, FEDERAL EXCISE, CUSTOMS <!--[if gte mso 10]> INCOME TAX, SALES TAX, FEDERAL EXCISE, CUSTOMS COMPANY LAW By Iftikhar Shabbir Syed, Tax Consultant, Lahore This compilation is primarily focused on providing authentic and updated material to professionals and others. It may not be considered as exhaustive as this set out interpretation of certain important amendments made by the Finance Act, 2009 in a summarized manner sufficient enough to amplify the important aspects of the changes made. It is suggested that the text of the Act and the relevant notification, where applicable, be referred to, in considering the interpretation of any provisions. INCOME TAX - SALIENT FEATURES 1. Basic limit of exemption for income tax in respect of salaried persons is increased from Rs.1,80,000 to Rs.2,00,000. In case of women salaried taxpayer, this limit is increased from Rs.2,40,000 to Rs. 2,60,000. 2. It is mandatory vide S.R.O. 684(I)/2009, dated 23-7-2009 for Registered Sales Tax Payers and AOP'S to file Income Tax Returns and Withholding Tax Statements electronically from July 1, 2009. [Section 237(1)] 3. Where Salary income, for the tax year is five hundred thousand rupees or more the tax payer shall file return of Income electronically. [Section 115(1)] 4. In order to support Internally Displaced Persons (IDPs) in their habilitation a new tax is imposed to be charged on taxable income of one million rupees or more @ 5% of such tax and in case of corporate executives @ 30% of the bonus. This is a one time levy and payable for tax year 2009 only. 5. Filing of Wealth Statement and Wealth Reconciliation is mandatory for every person (other than a company) falling under final tax regime FTR tax paid during the year amounting to Rs.20,000 or more and in case of salaried and business individuals where declared income is Rs.500,000 or more. [Section 116] 6. Tax deducted on the monthly electricity bills up to Rs.30,000 will be treated as an expense and will not be refundable. However tax deducted exceeding Rs.30,000 will be adjustable which consequently could be refunded. [Section 235 (4) (a)] 7. Presently advance tax is payable in four quarterly instalments oft the basis of last assessed income. According to newly inserted subsection (4AAA) tax liability under section 113 shall also be taken into account while working out payment of advance tax liability in case of a company or association of person. 8. The rate of withholding tax on imports is increased to 4% against the previous rate of 2%. [Section 148]. 9. It has been noticed that the facility of tax exemption available to educational institution is being grossly misused by private universities and medical colleges etc. Therefore, such facility would only be available to those institutions which have been approved, by the concerned Director General of LTU/RTO within six months from the date of notification of the Act. [Clause 92 Second Schedule] 10. In view of the less margin of profit available to cigarettes and pharmaceuticals products distributors, withholding tax rate in respect of such tax payer is being reduced from 3.5% to 1%. [Section 153 (1) (a)] 11. Indenting commission receipts will now be taxed at the rate of five percent of gross receipts. [Section 154 (2)] 12. Senior citizens are .allowed 50% relief in tax liability provided the taxable income, in a tax year, does not exceed Rs. 5,00,000. In view of inflationary trend, same is enhanced to Rs. 7,50,000. [Clause (1 A) Part III of Second Schedule] 13. Receipts form accumulated balance of voluntary pension scheme is exempt up to 25% of the available balance. To provide relief to pensioner class this limit is enhanced to 50%. 14. The scope of advance tax collection on purchase of new locally manufactured motorcar/jeep is extended to all types of private motor vehicles. [Section 231 B] 15. The exemption regime provided under the second schedule to the Income Tax Ordinance has been reviewed to delete the redundant and unjustified exemptions as per detail given in the Finance Act. 16. At present no tax is collected on export of goods made without form "E" because in this case export proceeds are received in cash. An amendment has been made in section 154 whereby the Collector of Customs shall collect tax @ 1% at the time of clearing goods for export made without form "E". Presently such exports are mainly allowed to Afghanistan through land routes. 17. To encourage documentation of the financial transactions and broadening of tax base the manufacturers are being incentivized by allowing tax credit at 2.5% of the tax payable if they are able to make at least 90% of their sales to sales tax registered persons. [Section 65 Al 18. In order to curb the black money investment in non-productive sector the rate of CVT on transfer of immovable property is being enhanced from 2% to 4%. 19. Any person who having furnished a return or statement discovers any omission or error is allowed to furnish a revised return or statement for that tax year, at any time within five years from the end of the financial year in which the original return or statement was furnished. 20. Where an order giving rise to a refund is the subject matter of an appeal or further proceedings under the Ordinance, the Commissioner may withhold refund till such time as he deems fit. [Section 170 A] 21. The rate of collection of advance tax at the time of sales by auction shall be 5% of the gross sale price of any property or goods sold by auction. [Section 236-A] 22. Every person who owns immoveable property with land area of 500 Sq.Yards or more located in a rating area, awns a flat having covered area of 2000 Sq.Ft or more located in a rating area, owns a motor vehicle having engine capacity above 1000CC and has obtained NTN is liable to furnish return of Income. Withdrawal of Exemption on import of ware potatoes and onion is aimed at providing protection to local growers of potato and onion effective from the 14th of June, 2009. Enhancement rate of Federal Excise Duty on locally produced Cigarette in different slabs effective from the 14th of June, 2009. Levy of FED on advertisement in newspapers, periodicals, hoarding boards, pole signs, sign boards and shop boards effective from the 1st July, 2009. The rate of FED on insurance services enhanced from 10% to 16% in VAT mode effective from the 1st July, 2009. The FED @ 16% at VAT mode has been levied on services provided by the port and terminal operators including wharfage in respect of imports effective from the 1st July, 2009. The FED @ 16% in VAT mode has been levied on services provided by stock brokers effective from the 1st July, 2009. Interest rates of banks to' avoid short filing by the tax payers, KIBOR (Karachi Inter Bank Offered Rates) plus three percent per annum has been introduced effective from the 1st July, 2009. The time limit which the Collector can extend in adjudication of Sales Tax cases has been reduced from 120 to 60 days and which can be extended by Federal Excise Officer in Federal Excise cases has been reduced from 90 to 60 days. The penalty/imprisonment for violation of section 40-B has been introduced to make enforcement more effective. It is effective from the 1st July, 2009. The time period for reopening the cases under Sales Tax Act, 1990 and Federal Excise Act, 2005 is being changed to three years. Effective from the 1st July, 2009. Sales Tax on local supplies of sugar to be charged @ 8 % [S.R.O. (sic)(I)2009] The Import and Supply of Platinum, Palladium ,Diamonds and precious stones is exempted from levy of sales.[S.R.O. 720(I) 2009] SECTION WISE MAJOR CHANGES IN SALES TAX ACT, 1990 Section 11(4)-Assessment of Tax The time limit is reduced from 120 days to 60 days which the Collector can extend in adjudication of Sales Tax cases. To make this change in conformity with the similar change introduced through this Act in the Income Tax Ordinance 2001, a new provision has been added which lays down that any period during which the proceedings are adjourned on the request of the taxpayer or are postponed due to any appeal or preceding or for any other reason, shall be excluded from the computation of the periods specified in the first provision. So the period due to adjournment on the request of assesses or due to appeal shall be excluded from the period fixed. Section 34-Additional Tax Interest rates of banks to avoid short filing by taxpayers the charge of one and a half per cent per month has been replaced with the words KIBOR (Karachi Inter Bank Offered Rate) plus three per cent per annum. Section 36(3)-Recovery of tax not levied or short levied or erroneously refunded To make the period of making an order compatible with provision in section 11(4) the period for making such an order has been reduced from 120 days to 60 days. A new provision has also been added whereby any period during which the proceedings are adjourned on the request of the taxpayer or is postponed due to any appeal or proceedings or stay order, remand or alternative dispute resolution proceedings or for any other reason, shall be excluded in the computation of periods specified in the first provision. Section 45(1)-Power of Adjudication It is proposed to the change powers of adjudication with different adjudicating officers consequently serial Numbers (i), (ii), (iii), (iv) and (v) have been substituted to read as under:- (i) Additional Collector Cases falling under section 11 and section 36 without any restriction as to the amount of tax involved or amount erroneously refunded. (ii) Deputy Collector Cases falling under section 11 and section 36 provided that the amount of tax involved or the amount erroneously refunded does not exceed two and a half million rupees. (iii) Assistant Collector Cases falling under section 11 and section 36 provided that the amount of tax involved or the amount erroneously refunded does not exceed one million rupees. (iv) Assistant Collector/Senior Auditor Cases falling under section 11 and section 36 provided that the amount of tax involved or the amount erroneously refunded does not exceed ten thousand rupees. (v) Any officer of Sales Tax with any other designation Such cases as may be notified by the Board. Section 45 A- Power of the Board and Collector to call for record Subsection (3) has been amended to limit the period for reopening cases under the Sales Tax Act, 1990 and Federal Excise Act, 2005, from 5 years to 3 years from the date of original decision or order of the subordinate officer. This change shall be effective from 1 July, 2009. Section 45 A- Decision on Appeal To make the provisions of this section in line with similar provisions in other sections, the period for making a decision on appeal by the Collector has been reduced from 120 days to 60 days. A new provision has also been added as it is done with similar change in other sections whereby the period for adjournment on the request of the appellant, or postponement of proceedings or stay order, remand and ADR proceedings shall not be included in these 60 days. Section 47A- Indirect Taxes Settlement Committee Subsection (3) has been changed to provide the committee 180 days instead of 60 days for making recommendation for the-settlement. Subsection (3A) has been newly inserted providing that if the committee fails to make recommendations within the stipulated period under subsection (3) the Board may dissolve the committee and appoint a new committee. Section 67- Delayed Refund To make the provision compatible with the similar provisions in the income tax, this section has been changed to provide that in case of delayed refund the claimant shall be paid an additional amount based on KIBOR. Table 2 Serial number 11 has been inserted to exclude the words ware potatoes and onions meaning thereby that the exemption available on import of ware potatoes and onion has been withdrawn. This change shall be effective from 14 June, 2009. CUSTOMS -SALIENT FEATURES Items Exempted from Custom duty:- Relief goods donated for free distribution among victims of natural disaster or other catastrophes. Plant, machinery and equipment imported by way of donation for installation in the earth quake districts as certified by ERRA or National Disaster Management Authority. Surgical equipments of cardiology, cardiac surgery, neuro vascular, electro physiology, endo surgery, endoscopy, oncology, urology and gynecological disposables. Preferential duty on imports of about 34 different items from Peoples Republic of China, S.R.O. 497(I)/2009, including motor cars, refrigerators, freezers up to capacity of 800L, air conditioners etc. by way of exemption for whole of custom duty in excess of the range of 35% to 50% according to respective classification. Mobile phones reduced from Rs.750 per set to Rs.250 per set and regulatory duty of Rs.250 per set withdrawn. Custom Duty Reduced on following items:- From 10% to 5% on raw materials for manufacturing pre-fabricated steel buildings. From 32.5% to 20% on import of Kits for four stroke auto-rickshaws to promote local assembly and reduce cost of manufacturing. From 20% to 15% on import of Pharmaceutical packing materials (PVC rigid films and aluminum foil). STEPS REGARDING INCORPORATION OF COMPANY Confirm the availability of name from Registration office. Form 28 (Consent of Directors in case of public company only) 5. Form S-1 (Notice of Nomination of Nominee Director in case of single member company only) 6. Memorandum and Articles of Association (4 Sets) 7. Authority letter in favour of person applying for incorporation on Rs.500 Stamp Paper. 8. Challan of fees according to Authorized Capital. Requirements after obtaining Certificate of Incorporation * To appoint CEO within 14 Days. * To appoint Auditors within 60 Days. * To obtain certificate of Commencement of business only in case of Public Company. * To hold Statutory Meeting within six months after obtaining certificate of commencement of business. * To hold Annual General Meeting (AGM) within eighteen months after incorporation and subsequently once in every calendar year within a period of four months following the close of financial year.
