adj. 1. Favorable; producing benefits <beneficial ruling>. 2. Consisting in a right that derives from something other than legal title <beneficial interest in a trust>.

Beneficial holder of securities

a holder of equitable title to corporate stock. ( the stock is not registered under the holder's name in the corporation's records.

Beneficial interest

a right or expectancy in something (such as a trust or an estate), as opposed to legal title to that thing. ( for example, a person with a beneficial interest in a trust receives income from the trust but does not hold legal title to the trust property. Beneficial owner see owner.

Conditio beneficialis, quae statum construit, benigne secundum verborum intentionem est interpretanda; odiosa autem quae statum destruit stricte, secundum verborum proprietatem, accipienda

A beneficial condition that creates an estate ought to be construed favorably, according to the intention of the words; but a condition that destroys an estate is odious and ought to be construed according to the strict sense of the words.

beneficial enjoyment

The possession and benefit of property, but without legal title.

beneficial owner

1. One recognized in equity as the owner of something because use and title belong to that person, even though legal title may belong to someone else; esp., one for whom property is held in trust. - Also termed equitable owner. 2. A corporate shareholder who has the power to buy or sell the shares, but who is not registered on the corporation's books as the owner.

beneficial ownership

A beneficiary's interest in trust property.

beneficial power

A power that is executed for the benefit of the power's donee, as distinguished from a trust power, which is executed for the benefit of someone other than the power's donee (i.e., a trust beneficiary).

beneficial use

Property. The right to use property and all that makes that property desirable or habitable, such as light, air, and access, even if someone else owns the legal title to the property.
