Contumax
Hist. 1. A person found to be in contempt of court. 2. A person who is accused of a crime but refuses to appear and answer the charge.
Nemo inauditus condemnari debet, si non sit contumax
No one ought to be condemned unheard, unless he is obstinate (in refusing to appear).
