Falcidian portion

Roman law. The one-fourth part of an estate that one or more instituted heirs are entitled to retain. ( The Falcidian portion has been abolished in Louisiana, but a legitime heir is entitled to a portion by law. -Also termed quarta falcidia. See forced heir under HEIR; LEGITIME.

Proportionality

Int'l law. The principle that the use of force should be in proportion to the threat or grievance provoking the use of force.

apportionment

n. 1. division into proportionate shares. 2. the act of allocating or attributing moneys or expenses in a given way, as when a taxpayer allocates part of profits to a particular tax year or part of the use of a personal asset to a business. 3. distribution of legislative seats among districts that are entitled to representation; esp., the allocation o1 congressional representatives among the state. based on population, as required by the 14th amendment. ( the claim that a state is denying the right of representation to its citizens through improper apportionment presents a justiciable issue. - also termed legislative apportionment. see reapportionment. 4. the division (by statute or by the testator's instruction) of an estate-tax liability among persons interested in an estate. - apportion, ub.

apportionment clause.

insurance. a policy provision that distributes insurance proceeds in proportion to the total coverage.

apportionment of liability

torts. the parceling out of liability for an injury among multiple tortfeasors, and possibly the plaintiff as well. ( apportionment of liability encompasses such legal doctrines as joint and several liability, comparative responsibility, indemnity, and settlements. see restatement (third) of torts: apportionment of liability (1999).

n. [Law Latin "of the disburdening of a pro rata share"] Hist. A writ for someone who is forced to pay rent that others are supposed to proportionately contribute to.

de onerando pro rata portione

n. [Law Latin "of charging according to a ratable proportion"] Hist. A writ for a joint tenant or cotenant who is distrained for more rent than is proportionately required.

The portion of property that can be willed to anyone the testator chooses.

Criminal law. An appellate court's analysis of whether a death sentence is arbitrary or capricious by comparing the case in which it was imposed with similar cases in which the death penalty was approved or disapproved.

reapportionment

n. Realignment of a legislative district's boundaries to reflect changes in population. ( The U.S. Supreme Court has required federal reapportionment. See U.S. Const. art. I, ยง 2, cl. 3. - Also termed redistricting. - reapportion, ub. Cf. GERRYMANDERING.
