Clausula quae abrogationem excludit ab initio non valet
A clause that precludes abrogation is invalid from the beginning.
Confirmatio omnes supplet defectus, licet id quod actum est ab initio non valuit
Confirmation supplies all defects, even if that which has been done was not valid at the beginning.
Cum actio fuerit mere criminalis, institui poterit ab initio criminaliter vel civiliter
When an action is purely criminal, it can be instituted from the beginning either criminally or civilly.

An independent subsidiary proluise whose breach does not discharge the contract, but gives to the injured party a right of action for the damage sustained as a result of the breach. Cf. warranty ex post facto.
