executor's bond

See BOND (2;

executor's bond.

A bond given to ensure the executor's faithful administration of the estate. See fiduciary bond. "The English law did not require an executor to give bond because he was appointed by the testator and his authority was derived from the will rather than court appointment. Some American jurisdictions do not require a bond of an executor. In the majority of our states a testator may by will dispense with the executor's bond, but in absence of such testamentary provision a bond will be required." Thomas E. Atkinson, Handbook of the Law of Wills ยง 113, at 621 (2d ed. 1953).
