Extradition Clause
The clause of the U.S. Constitution providing that any accused person who flees to another state must, on request of the executive authority of the state where the crime was committed, be returned to that state. U.S. Const. art. IV, ยง 2, cl. 2.
extradition
The official surrender of an alleged criminal by one state or nation to another having jurisdiction over the crime charged; the return of a fugitive from justice, regardless of consent, by the authorities where the fugitive resides. Cf. RENDITION (2).
extradition treaty
A treaty governing the preconditions for, and exceptions to, the surrender of a fugitive from justice by the fugitive's country of residence to another country claiming criminal jurisdiction over the fugitive.
extradition warrant
A warrant for the return of a fugitive from one jurisdiction to another. Cf. rendition warrant.
international extradition
Extradition in response to a demand made by the executive of one nation on the executive of another nation. ( This procedure is regulated by treaties.

Extradition in response to a demand made by the governor of one state on the governor of another state. ( This procedure is provided for by the federal constitution, by federal statute, and by state statutes.
