Promutuum

[Latin "as if lent"] Civil law. A quasi-contract in which a person who received money or property in error agrees to return what was received to the person who paid it.

mutuum

1. A transaction (sometimes referred to as a bailment) in which goods are delivered, but instead of being returned, are replaced by other goods of the same kind. ( At common law such a transaction is regarded as a sale or exchange, and not as a bailment, because the particular goods are not returned. 2. Roman law. A loan in which the borrower is entitled to consume the goods lent and return an equivalent amount. ( This was one of three types of contract for permissive use, the other two being commodatum (kom-aday-tam) and locatio conductio (loh-kay-sheeoh kan-dak-shee-oh).
