real contract
1 Hist. A contract in which money or other property passes from one party to another. ( This term, derived from the Roman law, referred to contracts concerning both personal and real property. 2. Roman law. A contract requiring something more than mere consent, such as the lending of money or the delivery of a thing. Cf. consensual contract. "The essence of . . . the real contracts, was that, at the time the agreement was made, one party, by delivering something belonging to him to the other party to the contract, imposed on that other an obligation to return the thing itself or, in the case of things intended to be consumed, an equivalent in kind. As the Roman lawyers expressed it, the contractual obligation was created by something being handed over ...." R.W. Leage, Roman Private Law 292 (C.H. Ziegler ed., 2d ed. 1930).
