same-evidence test

Criminal law. A test of whether the facts alleged in a given case are essentially identical to those alleged in a previous case. ( If they are the same, the Fifth Amendment's prohibition against double jeopardy will bar the later action, which is essentially a second prosecution for the same offense. This principle was first announced in Blockburger u. United States, 284 U.S. 299, 52 S.Ct. 180 (1932). - Also termed Blockburger test; actual-evidence test.
