BALUCHISTAN DEPUTY SUPERINTENDENTS OF POLICE SERVICE RULES, 1978 BALUCHISTAN DEPUTY SUPERINTENDENTS OF POLICE SERVICE RULES, 1978 [8th June 19781 No. SO. 11 (27) (R)/S & GAD‑73.‑In exercise of the powers conferred by section 25 of the Baluchistan Civil Servants Act, 1974 (Baluchistan Act IX of 1974) and in supersession of the West Pakistan Deputy Superintendents of Police Service Rules, 1964, the Governor of Baluchistan is pleased to make the following rules in respect of the Baluchistan Deputy Superintendents of Police Service, namely :‑. PART I‑GENERAL 1. Short title, commencement and application.‑(1) These rules may be called the Baluchistan Deputy Superintendents of Police Service Rules, 1978. (2) They shall come into force at once. 2. Definitions.‑In these rules, unless the context otherwise requires, the following shall have the meanings hereby respectively assigned to them, that is to say :‑ (a) "Appointing authority" means the authority specified in rule 4 ; (b) "Branch" means a branch of the Department organized as a separate and self‑contained unit such as General Branch, Prosecuting Branch, Tele communications Branch, Special Branch, Motor Transport Branch, Finger Print Branch and Anti‑Corruption Branch ; (c) "Chief Secretary" means Chief Secretary of the Government of Baluchistan ; (d) "Commission" means the Baluchistan Public Service Commission ; (e) "Department" means the Police Department, Baluchistan ; (f) "Government" means the Government of Baluchistan ; (g) "Home Secretary" means Home Secretary, Government of Baluchistan ; (h) "Inspector‑General" means inspector‑General of Police, Baluchistan ; (i) "Inspector" means Inspector of Police ; ( j) "Service" means the Baluchistan Deputy Superintendent of Police PART II‑RECRUITMENT 3. Constitution and composition of service.‑(1) The Service shall consist of the various branches of the Police Department. (2) Each branch of the service shall comprise the posts of Deputy Superintendents of Police and such other equivalent posts in the Department as may be specified by Government from time to time. (3) Members of telecommunication branch and M. T. branch shall not be eligible, for appointment to a post borne on any other branch of the service-- 4. Appointing authority.---- Appointments the Service shall be made by the Government. 5. "Selection Authority".‑Means a Selection Committee consisting of Chief Secretary as its Chairman, Home Secretary and Inspector‑General as its members, on the recommendations of or in consultation with 2. No licensee shall sell intoxicating liquor to any Muslim citizen of Pakistan for consumption by him. which the Government may make appointment of the Deputy Superintendents of Police in Baluchistan against the vacancies specified in sub‑rule (b) of rule 6 (1). 6. Method of recruitment.‑(l) Recruitment to the service shall be made in the following manner ‑ (a) 50 % of the vacancies in the service shall be filled by initial recruitment on the recommendation of the Commission. (b) 50 % of the vacancies in the service shall be filled by promotion from among Inspectors of Police on the recommendation of the Selection authority. (2) The Inspector‑General of Police shall maintain a Select List in Form I appended to these rules of Inspectors who are considered fit for promotion to the Service in the respective Branch. The Select List shall be in parts ; and each part shall appertain to a separate branch. (3) Recruitment to the Service by promotion shall be made from among Inspectors whose names appear in the Select List maintained in accordance with the provision of sub‑rule (2) for the branch in which the vacancies occur. (4) No entry shall be made in the Select List to be maintained under the provisions of this rule, nor shall an entry appearing therein be removed or the order in which the names appear in it be altered without the previous approval of the Selection Authority. (5) When an appointment is to be made from among persons whose names appear in the Select List, the order in which the names appear in the Select List shall, as far as possible be followed. 7. Age.‑No person shall be appointed to the Service by initial recruit ment who is less than 18 years or more than 28 years of age; Provided that upper age limit in case of person already in the service of the Police Department shall be 40 years. 8. Qualifications of Candidates.‑(1) No person shall be appointed to the service by initial recruitment unless he is a graduate of a recognised University, has a minimum height 5'‑2' without shoes relaxation by 2' in very special case and normal chest measurement of 30' with an expansion of '. (2) No person not already in Government Service, shall be appointed to the Service unless he produces a Certificate of character from the principal academic officer of the academic institution last attended and also certificates of character from two other responsible persons, not being his relatives, who are well acquainted with his character and antecedents. PART III‑CONDITIONS OF SERVICE 9. Probation.‑ (1) Persons appointed to the service against substantive vacancies shall remain on probation for a period of two years if appointed by initial recruitment and for a period of one year if appointed otherwise. (2) If the work or conduct of a member of the Service during the period of probation has been unsatisfactory, the Government may, notwithstanding that the period of probation has not expired, dispense with his services, if he has been appointed by initial recruitment, and if he has been appointed otherwise, revert him to his former post, or if there be no such post, dispense with his services. (3) On completion of the period of probation by a member of the Service, the Government may, subject to the provisions of sub‑rule (4), either confirm him in his appointment or if his work or conduct has, in the opinion of the Government not been satisfactory‑ (a) in case he has been appointed by initial recruitment, dispense with his services, or (b) in case he has been appointed otherwise, revert him to his former post, and if there be no such post, dispense with his service, or (c) extend the period of probation by a period not exceeding two years in all in case of persons appointed to the service otherwise and during or on the expiry of such period, pass such orders as he could have passed during or the expiry of the initial probationary period. Explanation I. ‑ If no orders have been made by the day following the completion of the initial probationary period, the probation shall be deemed to have been extended. Explanation II.‑If no orders have been made by the day on which the maximum period of probation expires, the probationer shall, subject to the provisions of sub‑rule (4) be deemed to have been confirmed in his appointment from the date his probation was last extended or may be deemed to have been so extended.. (4) No person shall be confirmed in the Service unless he successfully completes such training and passes such departmental examinations as may be prescribed by Government from time to time. (5) If a member of the Service fails to complete successfully any training or pass any departmental examinations prescribed under sub‑rule (4) within such period or in such number of attempts as may be prescribed by Government, the Government may‑ (a) in case he has been appointed by initial recruitment, dispense with his services ; and (b) in case he has been appointed, otherwise, revert him to his former post, or if there be to such post dispense with his services. 10. Seniority.‑(1) The seniority inter se of the members of the Service in the various branches thereof shall be determined‑ (a) in the case of officers appointed by initial recruitment, in accordance with the order of merit assigned by the Selection Authority ; provided that persons selected for the Service in an earlier selection shall rank senior to the persons selected in a later selection ; and (b) fn the case of officers appointed otherwise, with reference to the dates of their continuous appointment therein provided that if the date of continuous appointment in respect of two or more officers is the same, the older officer, if no Junior to the younger officer or officers in the next below grade, shall rank senior to the younger officer or officers. Explanation I.‑If a Junior officer in a lower grade is promoted to a higher grade temporarily in the public interest ; even though continuing later permanently in the higher grade, it would not adversely affect the interest of his seniors in the fixation of his seniority in the higher grade. Explanation II‑If a Junior officer in a lower grade is promoted to a higher grade by superseding a senior officer and subsequently that officer is also promoted, the officer promoted first shall rank senior to the officer promoted subsequently. (2) The seniority of the members of the service appointed by initial recruitment vis‑a‑vis those appointed otherwise shall be determined‑ (a) in case both the officers appointed by initial recruitment and those appointed otherwise have been appointed against substantive vacancies, with reference to the date of appointment to such vacancy in the case of an officer appointed by initial recruitment a‑ d to the date of continuous appointment against such vacancy in the case of an officer appointed otherwise provided that if the two dates are the same, the officer appointed otherwise shall rank senior to the officer appointed by initial recruitment ; (b) in case the officer appointed by initial recruitment, has been appointed against a substantive vacancy and the officer appointed otherwise has been appointed against a temporary vacancy, the officer appointed by initial recruitment shall rank senior to the officer appointed otherwise : and (c) in case the officer appointed otherwise is appointed against a substantive vacancy and the officer appointed by initial recruitment is appointed against a temporary vacancy, the officer appointed otherwise shall rank senior to the officer appointed by initial recruitment. 11. Liability to transfer and serve.‑Members of the Service shall be liable‑ (a) to transfer ‑anywhere in Baluchistan, and (b) to serve in any branch or Department of Government or any local authority or statutory body set up or established by Government. 12. General Rules.‑In all matters not expressly provided for in these rules, members of the Service shall be governed by such rules as have been or may hereafter be framed by Government and made applicable to them. 13. Relaxation.‑Any of these rules may, for reasons to be recorded in writing, be relaxed in individual cases if Government is satisfied that a strict application of the rule would cause undue hardship to the individual concerned. 14. Delegation.‑The Government may delegate all or any of its powers under these rules to any officer subordinate to it. 15. Power of Governor to safeguard rights of Government Servants.---- Whenever in the application of these rules, the terms and conditions of service of any person serving in connection with the affairs of the Province of Baluchistan, as guaranteed by any law for the time being in force, are likely to be adversely affected, the Governor of Baluchistan shall make appropriate orders to safeguard the constitutional and legal rights of such person.
