DISTRICT LAW OFFICERS APPOINTMENT RULES, 1978 DISTRICT LAW OFFICERS APPOINTMENT RULES, 1978 [Gazette of Baluchistan, Extraordinary, 8th June 1978] No. SO-II-11 (27) (R)/S & GAD-78.-In exercise of the powers conferred by section 25 of the Baluchistan Civil Servants Act, 1974, the Government of Baluchistan is pleased to make the following Rules, namely,:- 1. Short title and commencement.-(i) These Rules may be called the District Law Officers Appointment Rules, 1978. (ii) They shall come into force at once. 2. Definitions.-(a) "Commission" means the Baluchistan Public Service Commission ; (b) "District Law Officers" means the District Attorney and shall include Assistant District Attorney; (c) "Government" means the Government of Baluchistan ; (d) "Initial Recruitment" means the appointments made otherwise than by promotion ; (e) "Recognized University" means any University incorporated by law in Pakistan or any other University declared by the Government in consultation with the Commission to be recognized University for the purposes of these Rules ; and (f) "Service" means the District Law Officers Service. 3. Constitution of Service.-The Service shall comprise of the posts of District Attorneys and Assistant District Attorneys. 4. Appointing Authority.-Appointment to the Service shall be made by Government. 5. Method of Recruitment.-(1) Appointment to the existing posts of District Attorneys shall be made from the persons already holding the posts of Public Prosecutors/Government Pleaders and thereafter on falling vacant, these posts shall be filled in :---- (a) Fifty per cent. by promotion from among the Assistant District Attorneys ; and (b) Fifty per cent. by initial recruitment on the recommendation of the Commission. (2) Appointment to the post of Assistant District Attorneys shall be made by initial recruitment on the recommendation of the Commission. 6. Age.-(1) Subject to Rule 5 (1) no person, who is less than 30 years or more than 35 years of age, shall be appointed as District Attorney. (2) No person who is less than 27 years or more than 32 years of age. shall be appointed as Assistant District Attorney. 7. Qualifications.-No person shall be appointed to the post of District Attorney or Assistant District Attorney by initial recruitment unless he possesses a Degree in Law from a recognized University with 8 years standing at the Bar as an Advocate in case of District Attorney and with 5 years standing at the Bar as an advocate in case of Assistant District Attorney. 8. Seniority.-The seniority inter se of the members of Service shall be determined----- (a) in the case of members appointed by initial recruitment, in accordance with the order of merit assigned by the Commission provided that persons selected by the Service in an earlier Selection shall rank senior to the persons selected in a later selection ; and (b) in case of members appointed otherwise, with reference to the dates of their continuous appointment therein, provided that if the date of continuous appointment in case of two or more members of the service is the same, the older officer, if not junior to the younger officer or officers in the next below grade shall rank senior to the younger officer or officers. 9. Liability to transfer and serve.-Members of the Service shall be liable to transfer and serve anywhere in the Province of Baluchistan. 10. General Rules.-In all matters not expressly provided for in these Rules, members of the Service shall be governed by such Rules as have been or may hereafter be prescribed by Government and made applicable to them. 11. Relaxation.-Any of these Rules may, for reasons to be recorded in writing, be relaxed in individual cases, if Government is satisfied that a strict application of the Rule would cause undue hardship to the individual concerned, provided that wherever such relaxation involves a question on which consultation with the Commission is mandatory, the Commission shall be consulted before the relaxation is made. 12. Delegation.-Government may delegate all or any of its powers under these Rules to any officer subordinate to it.
