Section RULE

Abandoned Properties (Recovery of Arrears) Rules, 1977 [S.R.O. No. 945(I)/77 - In exercise of the powers conferred by Section 30 of the Abandoned Properties (Taking Over and Management) Act, 1975 (XX of 1975), the Federal Government is pleased to make the following rules, namely:] 1. Short Title and Commencement: (1) These rules may be called the Abandoned Properties (Recovery of Arrears) Rules, 1977. (2) They shall come into force at once. 2. Procedural Framework for Recovery: (1) Any dues, rents, or arrears payable to the Government of Pakistan or to the Board of Trustees in respect of any abandoned property shall be recovered in accordance with these rules. (2) The Administrator or Deputy Administrator appointed under Section 5 of the Act may issue a notice of demand to any person by whom any such arrears or dues are payable, requiring him to pay the amount specified in the notice within a period of thirty days. (3) If the amount specified in the notice of demand is not paid within the period of thirty days, the Administrator may forward a certificate of arrears to the Collector of the district in which the property is situated or the debtor resides or carries on business. (4) Upon receipt of the certificate, the Collector shall proceed to recover the amount specified therein as if it were an arrear of land revenue under the relevant Land Revenue Act.
