PROVINCIAL COUNCIL (ELECTION) RULES, 1983 PROVINCIAL COUNCIL (ELECTION) RULES, 1983 [Gazette of Baluchistan, Extraordinary, 17th January, 1984] No. 1-80/80 (PLGB) AO-IV.----In exercise of the power conferred by section 11 of the Baluchistan Provincial Council Ordinance, 1980 (VII of 1980, the Government of Baluchistan is pleased to make the following rules, namely :- 1. Short title and commencement.-(1) These rules, may be called the Representation of women, workers, peasants and minorities in the Provincial Council (Election) Rules, 1983. (2) They shall come into force at once. 2. Definitions.-In these rules; unless the context otherwise requires, the following expression shall have the meanings hereby respectively assigned to them, i.e. to say :- (i) "Division" means a Revenue Division of the Province of Baluchistan. (ii) "Local Council" means a 'local council constituted under section 10 of the Baluchistan Local Government Ordinance, 1980 ; (iii) "Local Councilor" means a member elected to a local council to represent minorities, and the special interest of women, workers and peasants ; (iv) "Member" means a member of the Provincial Council representing women, workers, peasants and minorities. 3. As soon as may be after the election of the loch councils, the following members shall be elected to the Provincial Council by every group of Local Councillors in the manner herein laid down :- (a) Local Councillors representing women,-in every Division shall elect one member from among themselves to the Provincial Council ; (b) Local Councillors representing the special interest group of workers in 'the Province shall elect one member from among themselves to the Provincial Council ; (c) Local Councillors representing the special interest group of peasants in every Division shall elect one member from among themselves to the Provincial Council. . (d) Local Councillors belonging to the minorities in the Province shall elect one member from among themselves to the Provincial Council. 4. Mode of Election.-The following shall be the Returning and Presiding Officers for the Election :- (a) Director, Local Government and Rural Development Buluchistan shall be the Returning Officer for the elections of members. (b) Deputy Commissioner Political Agent of the District shall be Presiding Officer for the election of members in his respective district/agency ; (c) Under the general direction of the Government, the Returning Officer shall notify the date of election to all the local councillors and ask for nominations of the candidates by a date which should not be less than seven days from the date of-the issue of notice ; (d)' The names of the candidates shall be communicated by the Returning Officer to the Presiding Officer alongwith the date on which the elections shall be held ; (e) The Presiding Officer shall hold elections through secret ballot at such places and in such manner as he may deem fit to ensure free and fair elections ; (f) The names of the candidates securing the highest number of votes shall be communicated to the Returning Officer within two days of the election Returning Officer &ball declare and notify the names of the successful candidates under intimation to the Provincial Government. (g) Where after the consolidation of the results under subsection (f ) above, it is found that there is equality in votes between two or more contesting candidates, the Returning officer shall in the presence of such candidates who are present, forthwith draw a lot in, respect of all such candidates having equal number of votes and the candidate on whom the lot falls shall be deemed to have received the highest number of votes, and may be declared elected. 5. Appeal:-(a) A candidate who has reasonable cause to challenge the election of any candidate may file an appeal within seven days from the date of declaration of result by Returning Officer 4o the Secretary, Local Government, Rural Development and Agrovilles Department. (b) An appeal shall be disposed of either summarily or after such summary enquiry as may be necessary ; (c) The decision of the Secretary, Local Government, Rural Development Agrovilles Department shall be final.
