ORDINANCE II OF 2008 ORDINANCE II OF 2008 BALOCHISTAN EDUCATION FOUNDATION (AMENDMENT) ORDINANCE, 2008 An Ordinance further to amend the Balochistan Education Foundation Act, 1994 (VII 1994). [Gazette of Balochistan Extraordinary 1st July, 2008] No.Legis 1-93/Law/92/4383-85, dated 1-7-2008.---The following Ordinance made by the Governor of Balochistan on 28th May 2008, is hereby published for general information: Whereas it is expedient further to amend the Balochistan Education Foundation Act, 1994, in the manner hereinafter appearing; And Whereas the Provincial Assembly of Balochistan is not in session and the Governor of Balochistan is satisfied that circumstances exist which render it necessary to take immediate action. Now Therefore, in exercise of the powers conferred by sub Article (1) of Article 128 of the Constitution of the Islamic Republic of Pakistan, 1973, the Governor of Balochistan is pleased to make and promulgate the following Ordinance:-- 6. Substitution of section 7 of Act VII of 1994.---In the said Act, for section 7 the following shall be substituted:-- "7. Appointment and Functions of the Managing Director.--(1) The Board shall appoint a full-time Managing Director from the private sector, from amongst a panel of five names to be submitted by the Chairman for consideration of the Board, whose qualification, terms and conditions of service shall be such as may be determined by the Board. (2) Subject to sub section (4), the tenure of the Managing Director shall be three years, which may be extended by the Board for a period not exceeding three years at a time. (3) The Managing Director shall be the Chief Executive Officer of the Foundation, and shall serve as a full member of he Board and, under the general supervision of the Board, shall exercise effective control over and make all decisions necessary for the smooth functioning of the day-to-day affairs of the Foundation. (4) The Board may remove the Managing Director on the ground of inefficiency or misconduct only after providing him an opportunity of being heard, and the decision of the Board shall be final. (5) The Managing Director shall be incharge of the Foundation, and shall exercise, in respect of the Foundation, all management, administrative and financial powers delegated by the Board; (6) In particular, and without prejudice to the generality of the foregoing, the Managing Director shall have the power and responsibility to:-- (a) exercise administrative control over all employees of the Foundation, including their appointment, removal and annual performance assessment, as may be prescribed; (b) submit annual budget proposals of the Foundation for the Board's approval; (c) maintain the accounts of the Foundation, and ensure timely completion of annual audit; (d) prepare the annual report, including the annual audited accounts, for approval by the Board; (e) act, on behalf of the Foundation, in an emergency when the Board's meeting is not expected to be held at short notice, subject to the obligation to report such action to the Board at it's next meeting and to seek the Board's ratification of any action so taken; (f) prepare and submit proposal for approval by the Board for the development of Educational institution, programmes and projects. (g) implement proposals approved by the Board; and (h) perform such other functions as may be delegated to him by the Board.
