ORDINANCE II OF 2011 ORDINANCE II OF 2011 BALOCHISTAN ESSENTIAL HEALTH SERVICES (CODE Of CONDUCT) ORDINANCE, 2011 An Ordinance to make provisions for better regulation of Health Services in Balochistan and the matters connected therewith or incidental thereto [Gazette of Balochistan, Extraordinary, 18th June, 2011] Legis:2-20/Law/2011, dated 18-6-2011.---The following Ordinance made by the Governor of Balochistan on 17th June, 2011 is hereby published for general information. Preamble.--Whereas it is necessary to make provisions for the different cadres of Health Services such as to establish a professional, efficient, effective, accountable and disciplined service for ensuring the maintenance of Health Care and for mobilization in the event of any exigency as well as the situation caused due to any natural disaster, it is expedient to provide for regulation of the Balochistan Essential Health Service and for the matters connected therewith or ancillary thereto; And whereas the Provincial assembly of Balochistan is not in session and the Governor is satisfied that circumstances, exist which render it necessary to take immediately action; Now, therefore, in exercise of the powers conferred by Article 128(1) of the Constitution of Islamic Republic of Pakistan, 1973, the Governor is pleased to make and promulgate the following Ordinance:-- CHAPER-1 PRELIMINARY 2. Definitions.--In this Ordinance, unless there is anything repugnant in the subject or context (a) "Code" means the Criminal Procedure Code, 1898 (Act V of 1898); (b) "Cognizable Offence" means an offence as defined in Criminal Procedure Code, 1898 (Act V of 1898); (c) "Court" means the court of an Executive Magistrate First Class under the Criminal Procedure Code, 1898 (Act V of 1898) or such other court to whom the District Magistrate may transfer the case for trial; (d) "Exigency of Service", means in relation to posting and transfer an urgent or unforeseen situation which, for the reason to be recorded in writing requires premature transfer of a member of Health Services for performance of specific tasks or duties but not as a replacement for what should be rightly treated as an efficiency and discipline matter; (e)"Financial Remunerations" means all Financial liabilities to which a Government Servant is entitled after retirement on superannuation period or qualifying service. It includes General Provident Fund, 'Commutation, Gratuity, Pension and Group Insurance etc; (f) "Member of Health Services" means all officials and officers appointed in Health department irrespective of grade, designation and place of posting. It inter alia, includes Doctors of all cadres, Paramedics, Nurses, Lady Health Visitors, Lady Health Workers, Pharmacists, Drug Inspectors and Ministerial Staff etc. of Health establishment;. (g) "Ordinance" means the Balochistan Essential Health Services (Code of Conduct) Ordinance, 2011; (h) "Private Practice" means delivery of Health Care Services in lieu of remuneration at private clinics or places other than Government Hospitals or those notified by Government from time to time; (i) "Rules" means rules made under this Ordinance; and (j) "Schedule" means schedule to this Ordinance.
