BALOCHISTAN LOCAL GOVERNMENT DELIMITATION RULES, 2011 BALOCHISTAN LOCAL GOVERNMENT DELIMITATION RULES, 2011 [Gazette of Balochistan, Extraordinary, 3rd May, 2011] No. S-1/2010/BLCEC/15185-15302, dated 3-5-2011.---In exercise of the powers conferred by section 141 of the Balochistan Local Government Act, 2010 (Act No.V of 2010), the Government of Balochistan is pleased to make the following rules, namely:--- CHAPTER-I PREIMINARY 1. Short title and commencement.---(1) These rules may be called the Balochistan Local Government Delimitation Rules, 2011. (2) They shall come into force at once. 2. Definitions.---(1) In these rules, unless there is anything repugnant in the subject or context,--- (a) "Act" means the Balochistan Local Government Act, 2010 (Act No.V of 2010); (b) "Appellate Authority" means an Appellate Authority appointed under these rules; (c) "delimitation officer" means a person appointed for delimitation of a ward and includes an Assistant Delimitation Officer performing the functions of a delimitation Officer; (d) "election" mean an election to a Local Council; (e) "form" means a form appended to these rules and includes a translation thereof into Urdu; (f) "publish" with its grammatical variations, includes exhibition at a place accessible to the public; (g) "rules" means the Balochistan Local Government Delimitation Rules, 2011; and (h) "ward" means an area of a Local Council delimited under the Act and the rules. CHAPTER-II DELIMITAION OF WARDS 3. For the purpose of election, a local area may be divided into such number of electoral units/wards, as the Government may determine keeping in view the population described in Chapter III of the Balochistan Local Government .Act, 2010 for various tiers of the Local Councils: Provided that fresh delimitation shall not be made unless:-. (i) fresh population census has taken place; (ii) administrative boundaries have been changed by Government; and (iii) the revision of existing delimitation of electoral units is desired by the Election Commission or by the Government. 4. Appointment of Delimitation Officer.--The Government may by notification in the official Gazette appoint as many delimitation officers 'as may be necessary for the delimitation of wards or for the revision of such delimitation under the rules. 5. Delimitation of Wards.--(1) As far as possible each ward will be a single member ward. (2) The ward showing extent of ward shall be delimited as far as practicable having regard to territorial unity, ethnographic factors, public convenience and other cogent factors so as to form compact and functional administrative, economic and geographical units: Provided that as far as possible there shall be maintained uniformity of population amongst various wards of a Local Council. (3) The number of members to be elected from each ward shall be fixed by the Government or an Officer authorized by Government in this behalf. 6. Proposals, objections, suggestions and recommendations.--(1) The Delimitation Officer appointed under rule 4 shall arrange to have a preliminary list of wards delimited under rule 5 and publish at his office and office of the Local Council on Form-I, together with a notice inviting objections and suggestions within a period of 10 days of the publication of preliminary lists. (2) Any person entitled to vote at an election of the Local Council within the period prescribed here above under sub-rule''(1), may file a petition containing his objection and suggestion in respect of a delimitation of wards, to the officer appointed in this behalf. (3) The officer to whom the objection petition has been preferred shall after hearing the parties and conducting such enquiries as it may deem necessary within a period of 15 days of the date of petition, shall decide the petition to make out a final list of recommendation on Form-I. (4) The Delimitation officer shall make such amendments, alterations or modifications in the preliminary list of wards, published under sub-rule (1), as may be required by decision on a petition, under sub-rule (3) (5) After incorporating the amendments, alteration or modifications, if any under sub-rule (4), the Delimitation Officer shall publish at his office and at the office of the Local Council concerned, the final list of recommendations on Form-I and forward it to the Government. 7. Appeals.--(1) Any voter of the Local Council concerned aggrieved with the order passed under sub-rule (3) of rule 6 may file appeal before the Government or an officer authorized by the Government in this behalf within seven days of such order. (2) The appeal filed under sub-rule (1) shall be disposed of by the Government or the officer authorized by Government as the case may be. (3) After disposal of appeals under sub-rule (2) if any, the Government shall finalize the list of electoral units and published it in the official Gazette. (4) The Government may, on its own motion or on a representation made to it, after hearing the parties if any, revise the final list of delimitation of a council, by recording reasons thereof and notify the same for general information. (5) The Government may, at any time correct any clerical error or any erroneous insertion or omission in the final lists.
