Section Provisions

BALOCHISTAN GOVERNMENT DELEGATION OF BALOCHISTAN GOVERNMENT DELEGATION OF POWERS UNDER THE FINANCIAL RULES AND POWER OF RE-APPROPRIATION RULES, 2008 (Insertion of R.16-A in Third Sched.) [Gazette of Balochistan Extraordinary, 25th May, 2012] No.FD(Reg-II)II-24/2010/771-1021, dated 25-5-2012.---In exercise of the powers conferred by Article 119 of the Constitution of the Islamic Republic of Pakistan, 1973, the Governor of Balochistan is pleased to make the following amendments in the Balochistan, Government Delegation of Powers under the Financial Rules and Power of Re-appropriation Rules, 2008, namely:-- In the aforesaid rules, in the THIRD SCHEDULE, after Sr. No.16 the following new Sr. No. shall be inserted; "16-A. LOCAL GOVERNMENT AND RURAL DEVELOPMENT DEPARTMENT "16-A Technical Sanction (a) in the case of original works 1. Administrative Department 2. Director General 3. Divisional Director Full Powers Full Powers Rs.1.0 millions Note:---These powers are subject to the conditions that:-- (i) excess amount over the amount for which Administrative Approval has been accorded does not exceed 10%. In case it does exceed, fresh Administrative Approval will be required; (ii) the above condition is only for those works which are likely to be completed within a period of one year; (iii) the above condition is not applicable on those works which are likely to be completed in more than one phase; and (iv) all the codal formalities shall be completed before granting Technical Sanction. (b) in the case of ordinary and special repairs to non-residential/office buildings. 1. Administrative Department 2. Director General 3. Divisional Director Full Powers Up to Rs.1.0 million in case of each building Up to Rs.0.5 million in case of each building 16.2. Administrative approval for works/ development schemes. 1. Administrative Department (in Departmental Selection Committee (DSC). Full Powers as prescribed 1. Administrative Department (without DSC). Rs5,000 million 2. Director General Rs.2.500 million 3. Divisional Director Rs.1,000 million Note:--I: When there is unanimity, no reference to the Provincial Development Working Party (PDWP) shall be necessary but in case of difference of opinion, the scheme shall be referred to the Provincial Development Working Party. (a) These powers shall be exercised only in respect of plans, schemes involving expenditure of development nature. The PC-1 should not include provision for staff and vehicles which should be got cleared from Finance Department prior to placing the PC-1 for consideration and approval of competent forum. (b) No expenditure on a scheme shall be incurred unless it is referred in the ADP/PSDP and there is a provision in the development budget of the year. (c) The schemes so approved and sanctioned shall be sent to the Planning and Development and Finance Department simultaneously for their record. (d) Where any of the members is not present, the scheme should not be approved unless that member has sent his comments in writing and these comments have been considered by the Departmental Selection Committee. (e) The schemes sanctioned should be in line with the objectives of the National/Provincial plans and there is no deviation from the principles and polices laid down in the plans. (f) The schemes do not have economic or other repercussions beyond the province. Note:-II: The powers delegated to the Administrative Department without Departmental Selection Committee, Heads of Departments and Offices in Category-I, shall be subject to the following conditions: - (a) No expenditure shall be incurred on a scheme unless necessary provision for such expenditur, exists in the development budget or the non-development budget of that year as the case may be (see also note 5(a). (b) In case of development schemes, copies thereof shall be sent to the Planning and Development Department and the Finance Department for their record. (c) The attendance of Planning and Finance representative shall be compulsory. Note:-III: The power for approval of scheme shall be subject to the following conditions: - (a) Where the schemes involve creation of new posts or purchase of vehicles, that portion of the scheme will be got cleared from Provincial Finance Department before considering the scheme for approval. (b) The committee shall not be competent to approve any scheme based on subsidy. (c) No scheme will be approved or implemented unless it is reflected in the ADP / PSDP or approved by the District Council. 16.3 Acceptance of Tenders. 1. Administrative Department Full Power 2. Director General Rs.15.00 million Note: - These powers are subject to the following conditions:-- (a) The prescribed procedure laid down for invitation of tenders is followed. (b) The rates quoted and/or amounts are such that the total cost of a project/works will not exceed the amount for which the project/works is administratively approved by more than 15% (fifteen per cent). 16.4 To divert provision for contingency of sanctioned estimates for purchase of survey items, provision for which could not be made in the original estimate i.e. stationary, survey equip-ments and instruments and scientific and drawing instruments required for preparation of estimates, furniture and equipment, for site office etc for the same works /estimate. 1. Director General 2.Divisional Director Full Powers Rs.10,000 provided that expendi-ture on scientific drawing and testing instruments does not exceed the approved estimate.
