Investigation and filling a case.---(1) Upon completion of an investigation and receipt of a complete report and after giving the concerned party an opportunity of being heard, the board shall recommend to Government whether or not to institute prosecution under this Act. (2) No court shall take cognizance of any offence punishable under this Act except on a report in writing by an officer authorized by Government through a notification in the official Gazette in this behalf. (3) An offence punishable under this Act shall be non-cognizable.
