THE ABASYN UNIVERSITY ACT, 2009 THE ABASYN UNIVERSITY ACT, 2009. (1[KHYBER PAKHTUNKHWA] ACT NO. XIII OF 2009) [First published after having received the assent of the Governor of the 1[Khyber Pakhtunkhwa] in the Gazette of 1[Khyber Pakhtunkhwa] (Extraordinary) ,dated the 24th October, 2009] 1.Substituted vide Khyber Pakhtunkhwa Act No. IV of 2011 AN ACT to provide for the establishment of a University at Peshawar in the name of Abasyn University. Preamble.---WHEREAS it is expedient to provide for the establishment of a University at Peshawar in the name of Abasyn University, in the private sector, and for matters ancillary thereto; It is hereby enacted as follows: SCHEDULE THE FIRST STATUTES 1. Faculties.---There shall be Faculty for department or a group of departments. The University shall include the following Faculties and such other faculties as may be prescribed: Faculty of Engineering; Faculty of Managements Science; Faculty of Information Technology; Faculty of Social Sciences; Faculty of Natural Sciences; and Such other Faculties as may be determined by the Senate. 2. Board of Faculty: (1) There shall be a Board of each Faculty, which shall consist of: the Dean of the Faculty; one nominee of the Board of Directors; the Professors and the Head of the department concerned in the Faculty; one nominee, other than Professors and Head of each departments, to be nominated by the respective Heads; two teachers to be nominated by the Academic Council by reason of their specialized knowledge of the subjects which, though not assigned to the Faculty, have in the opinion of the Academic Council, important bearing on the subjects assigned to the Faculty; two experts in the field from outside the University to be appointed by the Senate; and one nominee to be nominated by the Vice-Chancellor. (0) The members, other than ex-officio members, shall hold office for three years. (1) The quorum for a meeting of the Board of a Faculty shall be one half of the total number of members, a fraction being counted as one. 3. Board of Studies.---(1) There shall be a separate Board of Studies for each subject or group of subjects as may be prescribed by Regulations. (2) Each Boards of Studies shall consist of‑ (a) the Head of the department concerned; and (b) three to five experts or teachers with Ph.D, other than University teachers, to be appointed by the Vice-Chancellor in consultation with the Head of the departments. (3) The term of office of members of the Board of Studies, other than ex-Officio members, shall be three years. (4) The quorum for meeting of the Board of Studies shall be one half of the total number of members, a fraction being counted as one. (5) The Head of the departments concerned shall be the Chairperson and convener of the Board of Studies. 4. Functions of the Board of Faculty.---The Board of each Faculty, subject to the general control of the Academic Council and the Senate, shall have the powers to‑ (i) co-ordinate the teaching and research work in the subjects assigned to the Faculty; (ii) scrutinize the recommendations of the departments comprising the Faculty with regards to the appointment of paper setters and examiners for graduate and post graduate examinations and to forward the panel of suitable paper setters and examiners for each examination to the Vice- Chancellor for approval; (iii) consider any other academic matter relating to the Faculty and report thereof to the Academic Council; (iv) prepare a comprehensive annual report regarding the performance of each department concerned, comprising the Faculty for presentation to the Academic Council; and (v) perform such other functions as may be prescribed by Statutes. 5. Dean of Faculty.---(1) There shall be a Dean of each Faculty, who shall be the Chairperson and Convener of the Board of Faculty. (2) The Dean shall be appointed by the Senate on the recommendation of the Vice-Chancellor and shall hold office for a period upto three years and shall be eligible for re-appointment. (3) The Dean shall present candidates for admission to Degree (except honorary Degrees) in the courses falling within the purview of the Faculty. (4) The Dean shall have such powers and perform such duties as may be prescribed by the Senate. 6. Teaching Department.---(1) There shall be a Teaching Department for each subject or a group of subjects, as may be prescribed by Regulations and each Teaching Department shall be headed by a Head of department. (2) The Head of a Teaching Department‑ (a) shall be appointed by the Senate on the recommendations of the Vice-Chancellor for a period of three years and shall be eligible for re-appointment; (b) shall plan, organize and supervise the work of the Teaching Department and shall be responsible to the Dean for the work of his Teaching Department; (c) shall under the general supervision of the Vice-Chancellor and the Dean, exercise all administrative, financial and academic powers and such other duties and powers as may be assigned or delegated to him; and (d) shall prepare a comprehensive annual report on the performance of the Teaching Department at graduate and post graduate levels, and on Faculty research and development and submit it to the Dean of the Faculty for evaluation. 7. Selection Board.---(1) The Selection Board shall consist of:‑ the Vice-Chancellor (Chairman); two nominees of the Board of Directors; the Dean of the concerned Faculty; one eminent scholar nominated by the Chancellor; and Registrar, who shall also be the Secretary of the Board; (2) The members, other than ex-officio members, shall hold office for three years. (3) The quorum for a meeting of the Selection Board shall be four members. (4) No member who is a candidate for the post to which appointment is to be made, shall take part in the proceedings of the Board. (5) In selecting candidates for the posts of Professors and Associate Professors, the Selection Board shall co-opt or consult three experts in the subject concerned and in selecting candidates for other teaching posts two experts in the subject concerned, to be nominated by the Vice-Chancellor from a standing list of experts (revised from time to time) for each subject approved by the Senate on the recommendations of the Selection Board. 8. Functions of the Selection Board.---(1) The functions of the Selection Board shall be‑ (a) to consider the applications received from persons interested for appointment as Teachers/Officers and recommend to the Senate the names of suitable candidates for such appointment and also to recommend suitable salary for the person concerned; and (b) to consider all cases of promotion or selection of officers of the University and recommend the names of suitable candidates for such promotion or selection to the Senate. (2) In the event of an unresolved difference of opinion between the Selection Board and the Senate, the decision of the Chancellor shall be final. (3) The Chancellor shall have the power to directly appoint person of exceptional merit on an academic position for a specified period, not exceeding six months, on such terms and conditions as he may determine. I. the Vice-Chancellor (Chairman); II. on Dean to be nominated by the III. Chancellor; two nominees of the IV. Board of Directors; one nominee of the Senate; one nominee of Higher Education Department of the 8[Khyber Pakhtunkhwa] not below the rank of Additional Director Finance, who shall also be the Secretary of the Committee. (2) The term of office of the nominated members shall be three years. (3) The quorum for a meeting of the Finance and Planning committee shall be four members. 10. Functions of the Finance and Planning Committee.---The functions of the Finance and Planning Committee shall be‑ (i) to prepare the annual statement of accounts, propose annual budget estimates and advise the Senate thereon; (ii) to review periodically the financial position of the University; (iii) to prepare long term and short term development plans; and (iv) to perform such other functions as may be prescribed by Statutes.
