Section Provisions
Access Promotion Regulations, 2005
In exercise of the powers conferred by clause (o) of sub-section (2) of Section 5 of the Pakistan Telecommunication (Re-organization) Act, 1996 (XVII of 1996), the Pakistan Telecommunication Authority is pleased to make the following regulations, namely:
PART I - PRELIMINARY
1. Short Title and Commencement:
(1) These regulations may be called the Access Promotion Regulations, 2005.
(2) They shall come into force at once.
2. Definitions:
In these regulations, unless there is anything repugnant in the subject or context:
(a) "Access Promotion Rules" means the Access Promotion Rules, 2004, including any subsequent amendments.
(b) "APC for USF" means the portion of the Access Promotion Contribution on cellular termination that is diverted to the Universal Service Fund.
(c) "APCL" means Access Promotion Contribution for fixed-line Local Loop, Limited Mobility, or Wireless Local Loop services.
(d) "Approved Accounting Rate" means the total accounting rate approved by the Authority under the Access Promotion Rules.
(e) "Approved Settlement Rate" means half of the Approved Accounting Rate, representing out-payments between carriers.
(f) "Authority" means the Pakistan Telecommunication Authority.
PART II - ACCESS PROMOTION CONTRIBUTION (APC)
3. APC Payments and Structure:
(1) Long Distance & International (LDI) licensees shall pay Access Promotion Contributions (APC) to Local Loop (LL) licensees and the Universal Service Fund (USF) in accordance with the rates determined by the Authority from time to time.
(2) The APC payments shall be calculated based on the actual minutes of international incoming traffic routed through the LDI licensee's network.
(3) Licensees are required to submit monthly traffic data and corresponding payments to the USF and respective LL licensees within 90 days after the end of each calendar month.
(4) Licensees shall submit annual audited reports to the Authority detailing all transactions, traffic volumes, and payments related to the Access Promotion Contribution.
