CHAPTER VII THE ARBITRATION ACT, 1940 (X OF 1940) [11 March, 1940] An Act to consolidate and amend the law relating to Arbitration. WHERE it is expedient to consolidate and amend. the law relating to arbitration in Pakistan. It is hereby enacted as follows:‑ CHAPTER VII MISCELLANEOUS 47. Act to apply to all arbitrations. Subject to the provisions of Section 46, and save insofar as is otherwise provided by any law for the time being in force, the provision s of this Act shall apply to all arbitrations and to all proceedings thereunder: Provided that an arbitration award otherwise obtained may with the consent of all the parties interested be taken into consideration as a compromise or adjustment of a suit by any Court before which the suit is pending. Execution application. The principles applicable to suits would be applicable to execution proceedings also. Hence, a valid reference to arbitration in execution proceedings whether with or without the intervention of the Court followed by an award must be treated as an adjustment of the award.
