BALOCHISTAN MINERAL RULES, 2002 BALOCHISTAN MINERAL RULES, 2002 [Gazette of Balochistan, Extraordinary, 9th March, 2002] No. S.O.(MR)4-6/2002, dated 8-1-2002.--In exercise of the powers conferred by section 2, of the Regulation of Mines and Oil-Fields and Mineral Development (Government Control) Act, 1948, (XXIV of 1948) the Government of Balochistan is pleased to make the flowing Rules:-- PART V FINANCIAL 104. Payment of royalty. - (1) Royalty in respect of any mineral or group of minerals won, mined or found as provided in Rule 101 and disposed of shall be payable on the first day of January and the first day of July each year. (2) Where the holder of a mineral title or mineral concession failed to pay any amount of royalty as required by sub-rule (1), the following procedure shall be observed:- (i) the first two months shall be treated as grace period; (ii) penalty at the rate of 10% of royalty dues shall be charged in case the payment is made after the expiry of the second month next after the due date (iii) In case royalty along with penalty is not paid until the expire of the fourth months after the date it first becomes due as stated in sub-rule (2) (i) above action as provided in Rule 57(1)(0 shall be initiated. (3) The holder of a mineral title shall submit, in respect of each month before the 7th of each ensuing month and in such form and detail as the licensing authority may determine, a return shoe in the quantity and value of minerals produced and disposed of and the amount of royalty to be paid in respect thereof for that month. (4) The holder of a mineral concession shall submit a monthly production and disposal return on or before the 15th day of each succeeding month to the licensing authority on a form as determined by the licensing authority. A nil return has to be submitted in case there is no production in a month, with reasons thereof. If the returns are not received for three consecutive months the concession shall be liable for cancellation.
