ORDINANCE XVIII OF 2001 ORDINANCE XVIII OF 2001 BALOCHISTAN LOCAL GOVERNMENT ORDINANCE, 2001 An Ordinance to establish, reconstruct and regulate the Local Governments in the Province of Balochistan [Gazette of Balochistan, Extraordinary, 9th August, 2001] No. Legis:I‑122/Law/2000‑111, dated 9‑8‑2001.‑‑‑The following Ordinance made by the Governor of Balochistan on 8th August, 2001 is hereby published for general information: Whereas it is expedient to devolve political power and decentralize administrative and financial authority to accountable Local Governments for good governance, effective delivery of services and transparent decision making through institutionalized participation of the people at grass‑root level; And whereas the Provincial Assembly of Balochistan is dissolved, the Governor is satisfied that circumstances exist which render it necessary to take immediate action; Now, therefore, in pursuance of Article 4 of the Provisional Constitution (Amendment) Order, 1999 (Chief Executive's Order No.9 of 1999 and in exercise of all powers enabling in that behalf, the Governor of Balochistan is pleased to make and promulgate the following Ordinance:‑‑ CHAPTER XIX MISCELLANEOUS 196. Repeal and Savings.‑‑‑(1) On commencement of this Ordinance the following Ordinance are hereby repealed:‑‑ (a) The Balochistan Local Government Ordinance, 1980 (II of 1980); (b) the Balochistan Local Government Elections Ordinance, 2000 (VI of 2000): (2) All Municipal Corporations, District Council, Municipal Committees, Town Committees and Union Councils created under the Balochistan Local Government Ordinance, 1980 (II of 1980) shall stand dissolved. (3) Notwithstanding the repeal of the Balochistan Local Government Ordinance, 198.0 (II of 1980), and dissolution of all Municipal Corporations District Councils, Municipal Committees, Town Committees and Union Councils created under the Balochistan Local Government Ordinance, 1980 (11 of 1980), under subsection (1), subject to sections 4 and 23 of the Balochistan General Clauses Act, 1956 (W.P. Act VI of 1956), all rules, regulations and bye‑laws made, under the repealed Balochistan Local Government Ordinance, 1980, so far those are not inconsistent with the provisions of this Ordinance shall continue to be in force until amended or varied by the competent authority: . Provided that, until otherwise decided by the Government, the Local Government Boards established under the Balochistan Local Government Ordinance, 1980 (II of 1980), for the administrative control and affairs of officers and officials of the Local Council Service shall continue to function. (4) Notwithstanding the repeal of Balochistan Local Government Elections Ordinance, 2000 (VI of 2000), all Nazims, Naib Nazims, and members of the Local Governments elected under the said Ordinance shall deemed to be have been elected under this Ordinance and shall continue to hold their respective offices till the completion of their terms, unless earlier resigned or recalled under this Ordinance.
