Section Provisions

BALUCHISTAN LOCAL GOVERNMENT ORDINANCE, 1980 BALUCHISTAN LOCAL GOVERNMENT ORDINANCE, 1980 CHAPTER VI‑EXECUTIVE POWERS AND CONDUCT OF BUSINESS 38. Duties and Functions of Secretary.‑The Secretary shall subject to the general control of the Chairman, as the case may be‑ (a) supervise the financial and executive administration of the Council and perform all the duties, exercise all the powers specifically conferred upon him by, or delegated to him under this Ordinance ; (b) exercise supervision and control over the acts and proceedings of all officers and servants of the Council, in matters concerning administration, accounts and records of the Council, and subject further to the rules, bye‑laws and the terms and conditions of appointment of all such officers and servants under the Council, shall dispose of all questions relating to appointment, pay, privileges, leave, pension or allowances ; (c) furnish to the Government or such other officer as the Government may from time to time nominate in this behalf a copy of every resolution passed at every meeting of the Council ; (d) subject to the orders of the Chairman of the Council, take prompt steps to remove any irregularity pointed out by the auditor ; and (e) report to the Government, Chairman and the Council all cases of fraud, embezzlement to theft, or loss of money and property. (2) All licences and permissions shall, subject to the provisions of the Ordinance, Rules and bye‑laws and powers delegated in this behalf, be issued, granted or given under the signature of the Secretary and all fees payable for such licences and permissions issued, granted or given shall be received, recovered and credited to the Local Fund. (3) The Secretary may, subject to the general instructions of the Council, and after giving party concerned an opportunity to be heard in person, sus pend, withhold or withdraw any licence or permission granted or given under subsection (1) if he is satisfied that the licence of the permit holder has failed to comply with the terms and conditions of that licence or permit or has acted in contravention of the provision of this Ordinance. (4) The Secretary may delegate any of his powers or duties to any officer or servant ; provided that such delegation shall be subject to such limitations, if .any, as may be laid down by the Council. (5) The Secretary shall at any time supply any return statement, account or report or a copy of any document in his charge, called far by the Council or a Committee or sub‑Committee set up by the Council and shall comply with any orders passed by the Council or sub‑Committee in accordance with the provisions of this Ordinance.
