BALUCHISTAN LOCAL GOVERNMENT ORDINANCE, 1980 BALUCHISTAN LOCAL GOVERNMENT ORDINANCE, 1980 CHAPTER X‑ENCROACHMENTS AND ENVIRONMENT POLLUTION 53. Encroachments.‑(1) No person shall make an encroachment movable or immovable, on an open space or land vesting in, or managed, maintained or controlled by a Local Council or on, over or under a street, road, graveyard within the limits of Local Council or a drain except under a licence granted by Local Council and to the extent permitted by such licence. (2) A Local Council may remove the encroachment mentioned in sub section (l) with such force as may be necessary. (3) Whoever trespasses into or is in wrongful occupation of property which vests in or is managed, maintained or controlled by a Local Council may, in addition to other penalty to which he may be liable under this Ordinance or any other law for the time being in force, after such notice as may be provided by the Local Council, be ejected from such building or property by the Local Council with such force as may be necessary. (4) Any person aggrieved by notice issued under subsection (3) may within seven days of the service of notice, appeal to such authority as may be appointed by Government in this behalf whose decision thereon shall be final. (5) Notwithstanding anything contained in any other law, no compensa tion shall be payable for any encroachment removed under this section.
