Section Provisions

ORDINANCE II OF 1983 ORDINANCE II OF 1983 BANKING COMPANIES (RECOVERY OF LOANS) (AMENDMENT) ORDINANCE, 1983 8. Transfer of pending cases.‑(I) Any case which, immediately before the commencement of this Ordinance, was pending before a Special Court established under section 5 of the said Ordinance shall, on such commence ment, stand transferred to the Special Court which would have had jurisdiction in the case had‑it been instituted after such commencement. (2) In respect of a case transferred to a Special Court by virtue of sub section (1), the Special Court shall not, by reason of the said transfer, be bound to recall and rehear any witness who has given evidence before the transfer and may act on the evidence already recorded by or produced before the court from which the case is so transferred.
