BALUCHISTAN PROVINCIAL WORKERS' ALLOTMENT OF RESIDENTIAL PLOTS REGULATIONS, 1977 BALUCHISTAN PROVINCIAL WORKERS' ALLOTMENT OF RESIDENTIAL PLOTS REGULATIONS, 1977 [No. 20‑37/77‑Labour.‑‑-- 28th September, 1977 ‑‑ Regulations framed by Baluchistan Provincial Workers Welfare Board in exercise of the powers conferred by Section 11‑C (f) of the Worker's Welfare Fund Ordinance, 1971, for carrying into effect the scheme of residential plots to the workers in the Province of Baluchistan.] [Baluchistan Gaz. Extr. 28th Sep. 1977, p. 1] 1. Short title, extent and commencement‑-- (i) These regulation may be called the Baluchistan Provincial Workers Allotment of Residential Plots Regulation, 1977. (ii) These shall cone into force at once. 2. Definitions.‑----- In these regulations unless the context otherwise requires, the following expressions shall have the meanings hereby respectively assigned to then, that is to say :‑ (a) "Regulations" means the Baluchistan Workers' Allotment of Residential Plots Regulations, 1977. (b) "Ordinance" means the Workers Welfare Fund Ordinance, 1971. (c) "Worker" means a worker as defined in section 2 (XXVIII) of Industrial Relations Ordinance. 1969. (d) "Establishment" means an establishment as defined in Section 2 (IX) of Industrial Relations Ordinance, 1969. (e) "Industry" means an industry as defined in Section 2 (XIV) of Industrial Relations Ordinance, 1969. (f) "Secretary" means an. officer of the Workers' Welfare Board appointed to act as ex‑officio Secretary Allotment Committee. (g) "Allotment Committee" means the committee constituted under the Baluchistan Provincial Workers' Allotment of Residential Plots Regulations, 1977. (h) "Salary" means basic regular monthly wages including dearness allowance, adhoc relief, cost of living allowance etc., sanctioned by the Government from time‑to time, but does not include bonus or other monetary benefits, etc. (i) "Family" means his wife or her husband as the case may be and will include children wholly dependent on him or her. (j) "Station" means a town or a city where the residential plots have been developed for the purpose of allotment to the workers. (k) "Board". means the Provincial Workers' Welfare Board constituted under Section 11A of the Workers' Welfare Fund Ordinance, 1971. (l) "Form" means a form appended to the Regulations. 3. Constitution of Allotment Committee.‑-- (a) A Committee consisting of 3 members shall be constituted for the purpose of allotment of plots as under: (i) the Director Labour Welfare Baluchistan will act as Chairman of the said committee ; (ii) two other non‑official members representing the employers ‑a and workers of that station to be nominated by the Board ; and (iii) as officer of the Workers' Welfare, Board may be appointed as an ex‑officio Secretary Allotment Committee. (b) The term of non‑official members shall be two years. (c) Any member may, resign from the membership of the Allotment Committee‑ by intimating to the Chairman of the Committee. The Board may remove any member for gross mis‑conduct/corruption or on similar serious charges. Any member will cease to remain a member of the Allotment Committee, if be absents himself from the three consecutive meetings of the Committee. 4. Procedure for Allotment.‑--The following procedure shall inter alia be followed for allotment :‑‑ (a)The Allotment Committee will invite applications for allotment of plots from eligible workers of the station on the prescribed form 'P' and shall advertise the last date for the receipt of such applications through various information media. (b) Application forms should be serially numbered and shall be sold on price of Re. 1/‑ each by the Secretary, Allotment Committee. The names of the applicant(s) together with the amount realised shall be entered in a register maintained by the Secretary, Allotment Committee who will deposit the money so collected in fund to be constituted for the purpose. Any other application shall not be liable to be considered for allotment. (c) The application forms duly endorsed and certified by the managements of 'the Industry/Establishment/Factory concerned shall be entered in a proper register (Date wise) by the Secretary, Allotment Committee, 5. Eligibility.‑--A worker will be eligible to apply for allotment of one plot, and. shall neither be eligible to submit application for more than one plot at any one time, nor shall be entitled to allotment of more than one plot. He should also fulfil the following conditions and submit an affidavit, accompanying the application form, to the‑effect :‑ (i) He does not. own any house, plot or flat in any area of the station where the residential plots are 'available, in his own name or in the name of any member of his family; (ii) He is a permanent worker with at least one year of regular appointment ; (iii) He is working in an Industrial/Factory/Establishment which having 10 or more workers; (iv) He . works in an Industry/Factory/Establishment which is situated in Baluchistan ; (v) He is getting salary, less than Rs. 1000/‑ per month ; and he is a married person. 6. Scrutiny of applications:‑ (i) After the expiry of last date for submission the application so received will be scrutinised by the Allotment Committee. All such applications which do not fulfil the requirements enumerated in paragraph 5 (i) to (v) of Regulations will be summarily rejected under intimation to the applicant concerned, , (ii) Applications which are not accompanied by any affidavit affirming the fulfilment of conditions of eligibility, shall be liable to be rejected summarily. 7. Quorum.‑--The quorum for meeting of the Allotment Committee shall not be less than 2/3rd of the total number of members. 8. Allotment.‑--Allotment Committee after rejecting summarily the non‑entertainable applications as stated above will, if there are more applications in any station than the number of plots available proceed to make the allotment through drawing lots. The successful applicant will then be informed about the allotment of a plot to him. 9. Minute Rooks.‑---The proceedings of the allotment Committee in their meetings shall be recorded, is writing in the minute book which shall be kept as a permanent record by the Secretary Allotment Committee. 10. Price.‑---The plot will be allotted free of cost. . 11. Terms and conditions.‑-- (i) On allotment the allottee shall be required to take the posses sion of the plot within a specified time as may be intimated by the Chairman. Allotment Committee, in the allotment order, failing which the possession shall be deemed to have been taken‑over by him immediately after the expiry of the specified period. (ii) The allottee wall then be responsible to construct the house on the same plot within a period of three years from the date of allotment. (iii) The construction will be subject to, the rules and procedure laid down by the local body or any other concerned authority for the station, (iv) The allottee shall be bound to comply with and abide by the rules, regulations, orders or directions that may be issued by the Provincial Workers' Welfare Board from time to tinge. (v) The allottee shall not be entitled to sublet, mortgage or sell the plot. 12. Cancellation of Allotment.‑‑ (i) Any infringement of terms and conditions will render the allottee or his lessee/mortgagee/purchaser or both liable to ejectment from the plot and cancellation of the allotment. (ii) The Provincial Workers Welfare Board reserves to itself the right to cancel the allotment of the plot and resume possession of it in case any of the condition of the allotment is contraven ed and in such cases it shall be lawful to enter upon the allotted plot and take possession of the same or any building construct ed or other material found thereon without any liability to pay any compensation thereof. 13. Power to retake Amendment‑---The Baluchistan Provincial Workers' Welfare Board reserves the right to make amendments in these regulations as and when it deems necessary.
