It is duty of the Court to consider the prayer in juxtaposition with the contents of the plaint and to grant the relief in terms of the prayer clause irrespective of the fact that it was specifically mentioned therein or not.
Plaintiff was under obligation to seek all the reliefs about which he claimed to be entitled and such was not his prerogative to omit or relinquish any relief available to him
Court could grant leave to such extent and was empowered to grant such relief as the substantial justice required
Entire plaint was to be looked into for granting relief with reference to the substance
Court had ample power to grant the relief not specifically asked for either simply or in alternative.
Provisions of Order VII, Rule 7, C.P.C. empowered the court to grant an effective or ancillary relief even if not prayed, as the plaint as a whole was to be looked into in order to determine relief for which plaintiff was entitled, however, no relief could be granted upon facts and documents not disclosed in the pleadings.
