Rape was an offence against the whole society and case was registered in the name of the State, therefore where complainant party did not come forward to pursue the matter or produce evidence due to an out-of-court settlement, the State should come forward to pursue the case and courts should also take into consideration such aspects of the case while extending benefit to the accused.
