Hostile-witness was one whose manner of giving evidence showed that he was not desirous of telling the truth to the court
For declaring a witness to be hostile it was necessary to establish that he had made a statement against the record.
Fact that answers given by a witness to questions were in direct conflict with the evidence of other witnesses was not a reason for allowing the witness to be treated as hostile and for getting permission to cross-examine him.
