Demarcation report

Contention of petitioner was that he was owner of land measuring 26 Kanals and 15 Marlas and according to demarcation report land measuring 15 Kanals and 17 Marlas belonging to him was found to be 300 feet within the boundary of Capital Development Authority

Capital Development Authority was debarred from raising any objection with regard to the ownership of the petitioner as the same had attained finality in civil proceedings and the same had been admitted before the High Court in a constitutional petition and conceded in unequivocal terms before the High Court

Objections with regard to demarcation report had lost its significance when Authority was served with the notice and it failed to represent and deputed no official to attend the proceedings of the Commission appointed for demarcation

Authority was at liberty to depute any officer to attend the proceedings of demarcation but no reason or justification had been advanced for not deputing the same

Joint Commission was appointed with the consent of the parties

Authorities had failed to point out any legal infirmity or defect in the demarcation report which was in accordance with the provisions of law

Objections were rejected and Authority was directed to issue "no objection certificate" accordingly.
