Petitioner impugned increase in airport entry fee, levied by the Civil Aviation Authority on every individual entering the airport premises from rupees twenty to rupees forty

Contention of the Civil Aviation Authority on the other hand was that it was empowered under section 16 of the Civil Aviation Authority Ordinance, 1982 to levy said fee at rates as prescribed by it , to keep in check the unlimited entry of people into the parking and waiting area

Held, that imposition of entry fee on the visitors accompanying air passengers and collection thereof was hazardous to the security, control and good management, and was declared illegal by the High Court

High Court however observed that the Civil Aviation Authority may take measures to reduce and limit the number of visitors accompanying air passengers to the parking lot and waiting lounges

Constitutional petition was allowed, in circumstances.
