Meaning & Judicial Interpretation: (اردو مفہوم اور قانونی تشریح)
Officer who wants to make search of a person was obliged to call upon two or more inhabitants of the locality where the person was to be searched.
Provisions of S.103, Cr.P.C. were not attracted to the case of personal search of a person, but, where alleged recovery was made from accused, place of recovery was situated in a thickly populated area, omission to secure independent mashirs from the locality, was significant; and could not be brushed aside lightly.
Provisions of S.103, Cr.P.C. would not necessarily be complied with strictly in cases where same was effected on the pointation of accused.
