Meaning & Judicial Interpretation: (اردو مفہوم اور قانونی تشریح)
Constitutional petition under Art. 199 of the Constitution filed by contractual employees of the Board against their removal from service
Maintainability and competency
Services of contractual employees of the Board were not governed by any statutory rules and thus their constitutional petitions filed before the High Court were not competent; secondly, the employment of the said employees was contractual in nature and their services were terminated after due notice as per their contractual terms and conditions of service
Even on such account the constitutional petitions before the High Court were incompetent and had to fail
Appeal was allowed accordingly.
