Fiduciary

Fiduciary was a person in a position of trust, or occupying a position of power and confidence with respect to another; such that he was obliged by various rules of law to act solely in the interest of the other, whose rights he had to protect

Where a person had undertaken to act in the interests of another and where the nature of such relationship, its surrounding circumstances and the obligations attaching to it so required, it would be held to be fiduciary, however, the fact that it is categorized as fiduciary did not mean that all of the obligations arising from it are themselves fiduciary

Unless there were some special circumstances in the relationship, the duties that equity demanded from such fiduciary would be limited to what had been described as the core obligations: not to obtain any unauthorized benefit from the relationship and not to be in a position of conflict, which stem from the fundamental obligation of loyalty

Essence of "fiduciary obligation" is that the fiduciary is precluded from acting in any other way than in the interests of the person to whom the duty to so act is owed and fiduciary obligation was one of undivided loyalty.
