Offence under S.302, P.P.C. was compoundable by legal heirs of the victim, whereas offence under S.7 of Anti-Terrorism Act, 1997, had not been shown in the first and second column of table of S.345, Cr.P.C.
Such offence was not compoundable under the provisions of S. 345, Cr.P.C., as provisions of said section, could not be stretched too far by including therein a non-compoundable offence under the garb of humanitarian grounds; or on the ground that accused persons belonged to Rangers Force
Manner, in which brutal murder of the deceased was committed, caused sensation in society
Such offence being against society, it could not be permitted to be compounded by an individual/legal heir of the deceased on any score
Application filed for compounding of offence being without legal force, was dismissed, in circumstances.
