Petitioner had sought appointment order against the vacant post according to the merit list prepared by the Selection Committee

Validity

Department could not decline appointment to the petitioner as post was still vacant

High Court directed the department to appoint the petitioner forthwith against the post keeping in view his eligibility for the same and merit position

Constitutional petition was accepted in circumstances.

Petitioner being diploma holder in Associate Engineering applied for post of Educators in Education Department and qualified in written examination

Authorities had issued pre-interview tentative list that included name of petitioner but later on his name was dropped on the ground that he did not have requisite qualification of F.A./F.Sc.

Action of authorities being illegal was set aside and constitutional petition was allowed.
