Plaintiff is not permitted to seek a mere declaration without consequential relief when it is necessary for the full and complete enjoyment of the property
Object of this condition is to avoid the multiplicity of suits and litigation.
When suit for declaration was filed and the consequential relief which could have been granted was not sought by plaintiff, his such omission could not disentitle him for the relief
Opportunity could be granted to plaintiff for prayer of relief of possession and on the basis of such technicality, suit could not be dismissed.
