Record showed that accused was thirteen years of age at the time of commission of offence and at the time of conviction, he was of sixteen years
Although under S.11(a) of Juvenile Justice System Ordinance, 2000, court had discretion to release a juvenile on probation but, in the present case, accused-juvenile had committed rape with a minor girl and it was not appropriate to release the juvenile-accused on probation
Conviction and sentence of accused was maintained with the direction to send him to a borstal institution until he attained the age of eighteen or for the period of imprisonment, whichever was earlier
Appeal was dismissed accordingly.
