Owner of disputed property did not migrate from Pakistan at the time of partition but legal heirs of owner migrated from Pakistan and got settled in India
Property was declared to be a non-evacuee
After the death of owner, property was declared to be escheated property
Such declaration of property was valid.
Para. 493-Provisional Constitutional Order (1 of 1981), Art 9Lease of land made in favour of petitioner by A. C./Collector and not by Commissioner- Lease, held, not valid and petitioner has no; vested right in land.
