Accused had shown his bona fides by surrendering before High Court and only sought protection so that his right to approach competent Court or access to justice be ensured

Effect

Abscondance of accused was not unexplained and such factor would be considered by competent Court to which access was being sought by accused

Constitutional petition was allowed in circumstances.

S. 498-A-Anticipatory bail-Accused involved in another murder case and not appearing in case in hand on account of his reported abscondence in such other case-Accused, held, hardly deserves to remain on bail in case in hand.

Petitioner cited as accused in a series of criminal cases and at several place but no proceedings dings taken against him till filing of present petition-Petitioner's case, held, falls within purview of rule laid down in P L D 1953 F C 170 and P L D 1966 S C 589 and grant of bail eminently justified-Allegations against petitioner in any case, held further, require further inquiry and his case falls to be dealt with under S. 497(2).
