Para. 3.5-West Pakistan Revenue Department District Ministerial Service Rules, 1964, rr. 2(i), 5(8), 11 & Appendix-Apprentice junior clerk enlisted in accordance with para. 3.5, District Office Manual and having been given occasional chances to work as junior clerk (for seven years) as and when a post of junior clerk was available in District Administration-District Administration making certain appointments of junior clerks from outside the list maintained under para. 3.5 of District Office Manual-Provisions of para. 3.5, District Office Manual were not inconsistent with provisions of West Pakistan Revenue Department District Ministerial Service Rules, 1964-No repugnancy or inconsistency having been found between the two-With enforcement of Ministerial Rules of 1964, both prepared under para. 3.5 of District Office Manual did not stand repealed or revoked

Apprentice junior clerk had therefore, right under para. 3.5, District Office Manual to be appointed to any vacancy occurring in group of junior clerk

District Office Manual 1960, rr. 1 & 2, 3.6 & 3.14 and Appendix 3, Chapter Ill-Appellate Jurisdiction of Commissioner-Commissioner has no right of interference with working of office of Deputy Commissioner-Deputy Commissioner solely responsible to maintain his office properly and efficiently Commissioner has no appellate power against order of Deputy Commissioner under r. 3.6 promoting members of his establishment to selection posts as defined in r. 3.14-Persons affected on promotion of others by Deputy Commissioner to selection posts Not given, by law, status of aggrieved persons-Such persons have no right of appeal to Commissioner; they can, however, make representation to Financial Commissioner (Now Board of Revenue)-Appeal is a statutory remedy provided by law or rules made there under-No power of appeal inherent in Commissioner against every order of Deputy Commissioner in absence of express provision in law.
