Respondent Authority's order not confirming sale of plot in respondent's favour was set aside and case was remanded to Authority to decide the same in accordance with law.

Evacuee property declared as such by Custodian in 1975 but shares of non-evacuee not separated till its partition taking place in 1978

Respondents submitting forms for transfer, of portions in their occupations soon after property was partitioned and much before extended target date

Appellants` objections that submission of forms was time-barred and Authority had no jurisdiction to condone delay, held, misconceived

Shares of non-evacuee not having been separated, property in dispute became evacuee and available for transfer when its partition took place and it was only then that respondents could have applied for its transfer.
