Mueen, in a village, is a person who serves the people/inhabitants of the village, performing their functions in different categories like Dhobi (washerman), Tarkhan (Carpenter), Chowkidar (Watchman) and Chuhra (sweeper) etc.
All these persons serve the villagers/people and are known as village servants.
S. 24, Sched. II, cl. 5 -Colony Manual Punjab, Vol. II, para. 155-A-Arbitration clause in grant containing words "then save in so far as the decision of any such matter has been hereinbefore provided for and has been so decided" clearly excludes operation of condition empowering Collector to cancel the grant and resume possession of land in case of breach of any condition by grantee, from arbitration-,Validity of order passsed by Collector could thus not be challenged in arbitration proceedings initiated under cl. 5, Sched. II or as provided in Colony Manual, Vol. II, para. 155-A.
Comprehensive arbitration clause existing in sale-deed which visualised demand or liability to be recovered from a person party to dispute arising in connection with such sale or covenants of sale-Persons acting in capacity of an arbitrator, are real judges in that cause and they are supposed to apply their own independent mind on merits and demerits of a case free from bias and external influence
Writ petition disposed of by consensus of both parties in terms that petitioner would have recourse to remedy for arbitration of dispute.
Ss. 4 and 7-Case covered by clause (xiv) of S. 158 (2) of Punjab Land Revenue Act, 1887-S. 4 has no application to such case.
