Petitioner's application for protection and fixation of his pay was dismissed as also his appeal before Service Tribunal
Validity
Leave to appeal was granted to consider, whether petitioner was entitled to protection of his pay particularly keeping in view cases of other employees similarly placed which were differently treated and they were given protection to salaries which they were drawing in their parent department.

Not sufficient-Existence of rule of International Customary Law or General International Law-Held, can be established only when States shown to act in such way due to recognition of their legal obligation to such effect.
