Expressum Facit Cessare Facitum

Meaning of the maxim "Expressum facit cessare facitum" is that if doing of a particular thing was made lawful, doing of something in conflict with that, would be unlawful, so the things must be done in a way/procedure prescribed for it, to get its validity in the eye of law, otherwise it would not be conferred legality.

Principles enshrined in the maxim are attracted/applicable in all such proceedings intended to pass an adverse order against a party, if its application has not been expressly excluded.

When a deed or statute contains express covenants.or specific mention of things and contingencies, no implication of any covenant or contingency on the same subject-matter can be raised.

(i) Expressio unius personae vel rei, est exclusio alterius (express mention of one person or thing Is the exclusion of another) and (ii) Expressum facit cessare taciturn (what is expressed makes what is silent to cease).
