"In pari delicto potior est conditio defendentis' Courts would refuse to enforce an illegal agreement at the instance of a person who was himself a party to an illegality or fraud

Applicability

In absence of any evidence in support of the condition that plaintiffs (customer) were party to any fraud of the Bank officials or had knowledge of their misdeed, maxim "in pari delicto potior est conditio defendentis" would not be applicable.
