Plea raised by the petitioners was that liability outstanding against another commercial entity could not be made a ground to refuse the return of the security documents furnished by them

Contention of the Bank was that some other loan was outstanding against some other persons who were "dependent relatives" of the petitioner

Validity

Mere relationship of brother and sister between the parties did not make them a dependent relative of the petitioners

High Court directed the Bank to return the security documents of the petitioners

Petition was allowed accordingly.
